Nowadays,the development of commodity houses has been the main factor of the economical growth. More and more people live in the resident area with estate management. The early disputes were mainly about the quality of the house, the decrease of the the house's surface area and so on. With the number of the resident areas increasing, with the awareness of the resident right strengthened, the owners become more and more concern the right to exclusive use, such as the issue of the common ownership, the problem to whom the charge of the parking lot belong, the problem about the transfer of the parking lot, the problem about the incomes of renting the place for advertisements. What the residents consider rests not only on the house-living itself, but also the common ownership and the protection of the profits it brings to.In the existing legal system, the General Provisions of the Civil Law has not regulated the building's condominium ownership, the civil code is in the process of the formulation, and,"The Reality of Laws (Draft)"which regulates the condominium ownership is also in the process of formulating. As the result of that, the system of the buildings'condominium ownership has not been set up. The Estate Management Ordinance as the only rules about the estate management, is lack of the fundamental regulations, and the execution of the ordinance does exist many difficulties. The article six of the Estate Management Ordinance is the only provision about the right of the residents.
