Montesquieu And Enlightening Value From The Perspective Of Institutional Design

Montesguieu is an expounder of the idea of separation and balance of powers in modern western history with anti-abuse of power and guarantee of civilians'political rights as his core pursuit, limit and evilness of human beings as his theoretical hypothesis, and separation and balance of the three powers, constraint of power with power as his fundamental way of realization. As a historical stage that can not be substituted in evolution of political ideology, his ideology is valuable enlightenment to power mechanism in constructing democratic politic of modern countries.Therefore in China today, when we are enhancing the reform of political system and exploring a new pattern of legislation, interpretation of Montesguieu's L'Esprit des lois is especially useful and enlightening for construction of democratic legislation and morality, for heightening civilians'awareness of law, for anti-corruption, and also for creation of a democratic, socialist society ruled by law, a society with peace, justice, honesty, friendliness, vigorousness, order, and harmony between man and nature.The present paper, based on a thorough understanding of the essence of Montesguieu's ideology and an deep insight into the logical implication in the theory of separation and balance of powers and the initiatory value of modern China, attempts to provoke possible further study for establishing anti-corruption politics from the perspective of institutional design after remediation over our process of application and courageous borrowing of the western ideology and pattern of legislation.
