On Plea Bargaining System In Taiwan Area Of China

Plea bargaining produced in19th century in United States. Today, the development ofplea bargaining system has been more mature. According to statistics, in American morethan90%cases are resolved through plea bargaining procedure. In addition, the procedureis also transplanted to other countries and regions. In2004, Taiwan set up the plea bargainsystem in order to ease the pressure of cases. This paper is divided into six sections. It willdetailed introduce the plea bargaining system in Taiwan of China. The first, I will introducethe background of setting up plea bargaining system in Taiwan area of China. Then, thethesis will elaborated introduce the specific content of the system and compare it withAmerican and Italian plea bargaining systems. I will conclude the differences betweenthose systems in different countries and regions. Once more, I will make a criticalevaluation on the plea bargaining system in Taiwan area of China and find the advantagesand shortages of the systems. Finally, I will try to build the plea bargaining system in themainland of China and establish the security of the system. I hope that this system couldsolve the plight of judiciary and effectively reduce the pressure of judiciary.
