Although the Crimes of Misappropriating Public Funds, embezzling capital and misappropriating special property are respective branches of the crime of Corruption and Bribery and the crime of property violation, they have certain similarities in the constitution of crime; Legislature and judicial body have made many explanations of these three crimes on which, yet, divergences and debates from theorist and practitioners can not be half lessened. In this sense, it is necessary and feasible to make a systematic research on the three crimes so that we can solve the problem of misusing the terms in practice and embarrassment in theoretical study and we can find ways to modify and perfect the terms of misappropriating crimes.Part one, the author defines the crime of Misappropriation in terms of real law, and takes a comparative analysis of legislation on the crime of Misappropriation on the basis of summing up the evolvement of legislation on the crime of Misappropriation in China and reviewing the legislation of the crime of Misappropriation in foreign countries. Through such a historical and comparative analysis, we can see clearly the alternateness of the complicated crime of Misappropriation and understand the inner cause of the crime of Misappropriation and the advantages of the foreign legislation of the crime of Misappropriation.
