Compulsory Third Party Liability Insurance Study

Motor vehicle plays an active role in social economy and daily life. In the meantime, motor vehicle accidents caused a large number of damage and have become an important social problem in China. The Rode Traffic Safety Law of PRC came into forth on 1 May 2004.The article 17 of this law provides that China executes the motor vehicle liability compulsory insurance for the third party. In view of a great of hard nut in legislation and reality imminent need, it has strongly theoretical and realistic significance to establish and perfect the system of the motor vehicle liability compulsory insurance for the third party by learning from international experiences on the basis of our national conditions. There are 5 parts in all, excluding the preface.Part I is a summary of the motor vehicle liability compulsory insurance for the third party. It mainly introduces the basis theory about the motor vehicle liability compulsory insurance for the third party's definition, nature, formation history and development in China. It also makes a comparison between compulsory liability insurance for the third party and voluntary liability insurance for the third party.Party II explores the model of motor vehicle compulsory insurance. Firstly, it introduces the two models of motor vehicle compulsory insurance, i.e. no-fault insurance model and liability insurance model. Furthermore the differences of the two models are analyzed. This thesis comes into conclusion that Chinese motor vehicle compulsory insurance should adopt the actual model of liability insurance. Finally, the article 76 clause 1 of The Rode Traffic Safety Law is discussedPartIII is the main content of the motor vehicle liability compulsory insurance for the third party. In this part, seven important systems are expounded, including the scope and right of the third party; insurance coverage etc.PartIV expounds the rode traffic accident social assistant fund system. After introducing basis theory and analyzing the related problems, this thesis put forwards some suggestions to perfect our social assistant fund system.Part V discusses related safeguard measures to ensure effective implementation of the motor vehicle liability compulsory insurance for the third party.
