On The " Post Acts Of Economic Harm " Discussion On The Crime

Recently, duty-related economic crime committed by national public servants, such as corruption and bribery, becomes the cancer of society .It has aroused wide concerns of all walks of society. The harm is that, first, it has caused great economic losses to society; second, it ruins social values and last, it impairs public administration. Therefore, it is of important and practical significance to explore and find effective ways of prevention, on the basis of a theoretical study of duty-related economic crime .This article first gives a determination of definition and extent of duty-related economic crime, and according to the inevitability and significance of criminalization, suggests the trend of criminalization and brings forward some material advice. The whole article is made up of five chapters.Chapter 1 is the introduction. By analyzing the trend of duty-related economic crime ,which has the characteristics of the crime of one's position and economic crime, it points out the necessity of classifying the crime and expanding the duty-related economic crime's item on the lawmaking way.Chapter 2 gives a determination of definition and extent of duty-related economic crime. As a new term that has close relationship with crime of one's position and economic crime, it defines the definition of duty-related economic crime by the definition of crime of one's position and economic crime. In the light of behavior methods of duty-related economic crime of national public servants, it is divided into the following types: occupation type, bribe type, misappropriation type, and against socialist market economy order type.Chapter 3 analyses the significance of criminalization of duty-related economic malfeasance, and brings forward criminalizing them.
