Civil Forensic System

Judicial identification is an important way to prove fact of case .With the development and advance of science and technology judicial identification is increasingly significant. Expert witness has similar function as judicial identification in countries of Anglo -American law system .Because of the different litigant patterns and culture ,there are many different regulations and practice on the identifier's qualification ,legal status ,rights and obligations responsibilities and so on ,in the two law systems .Meanwhile ,there are respective means to examine and adopt the conclusion of identification.On the whole ,our system of judicial identification has far lagged behind our judicial reform .The problem of our system include the identifier ,the procedure and the examination of expert conclusion .Besides ,many problems are caused by the imperfection of our system ,such as ascertaining the effect of conclusion improperly ,repetitious identification ,few identifiers appearing in court ,imperfect responsibility mechanism, etc .So we should set about perfecting judicial identification in civil procedure .The reform of our judicial identification is a big social system .It relate to change of government function ,the patterns of trial and the transformation of civil procedure .In the process of reform ,we should draw lessons from foreign countries and base ourselves upon China' national conditions .
