Study Of The Jury System

Jury system refers to an important judicial and trial system that absorbs ordinary people to take part in the trial of civil and criminal cases. Based on a review of the jury system in the history, this article studies the gradual transformation of jury system from the ancient society to nowadays. Jury system is traceable to the ancient Greek and Rome, born and develop in the England , is refulgent in America, and alters in France and Germany. In modern society, ruled by law, jury system is popular and highly praised in many countries as the guarantee system for citizenship and democratic form for ordinary people to take part in judicial actions directly. However, jury system nowadays has a trend of decency in the worldwide. Despite its disappointed fact, we can still look forward to good future for people' s assessor system in China. This is not only because, in 2005 the implementation of "improving the people' s assessor system decision" on this issue demonstrates official position. More importantly, the overall quality of the people in my current circumstances is not high, the people' s assessor system is not only a security system to ensure that judges follow "the rules of experience " to trial , but also positive initiatives to popularize law education .Through the analysis of the poor operation of the people' s assessor system , both from the legislative and judicial practice thinking for the people' s assessor system , the author made a number of recommendations for further improvement.
