As a kind of developed electronic payment instrument, there are only 20 years since credit card entered into China in middle 1980', and the history of legislation on credit card crime is only 10 years. With the process of unification of the world' economy becoming faster and faster, the credit card business is keeping rapid developing step. While the disputes on credit card crime legislation keep incessant, the reason is because the partition between legislation and the practical operation to some degree, and the imperfection. To get rid of the passive and out-dated complexion, the dissertation argues that we should lucubrate the rule and characteristic of credit card crimes, and when the crime charges are designed, we not only pursue definitude and concretion to accord with the need of legislation, but should reach some degree of generalizing and forethought character, we should also give attention to the complex and levity character of financial movement, and make the criminal law structure and normal, scientific, concrete, and precise, so as to be convenient for practical application. On the base of bankcard payment as a most typical and mature way of modem electronic business movement, The dissertation attempts to explore the rule and characteristic of bankcard crime from bankcard payment's rule and future developing tendency, and in current framework of law stipulation, to explore to restrict the credit card fraud crime of Article 196, so as to do good to our country's bankcard crime legislation.Except foreword and epilogue, there are 4 parts in this dissertation:The first part focuses on the realistic status and legislation evolution of bankcard crimes. This part on the whole introduces the overview developing status of China's bankcard industry, the status quo and characteristic of bankcard crime, and the development of our country's bankcard crime legislation.The second part opens up the disputes and legislative deficiencies in our country's credit cards legislation before the new legislative explanation come into being.
