The United State passed continued dumping and subsidy offset Act of 2000 ("US -Offset Act (Byrd Amendment)") in 2000. The bill requires that the US government should allocate anti-dumping and countervailing duty from foreign companies directly and proportionally to domestic firms which support anti-dumping and countervailing actions, and should not turn all of the taxation to the Ministry of Finance. The taxation which are allocated to the domestic companies should be used to offset the losses these companies got in the process of dumping by foreign companies and should be used to improve manufacturing implements and equipments, to research and development, to train staffs, and so on. The United States' trade parties fiercely opposed the bill and decided to turn to the Dispute Settlement Body of WTO. The Dispute Settlement Body of WTO judged that Byrd Amendment violate 《Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994》 and 《Agreement on Subsidies and Countervailing Measures》 ,so the United States repealed this bill in 2005.Byrd Amendment, which is subject to fierce opposition from America's trade parties , are being discussed for a long time abroad but don't get more attention from our scholars. The first part writes the produce and influence of Byrd Amendment When a bill is passed, it should bring in some influence either positive or negative. This text analyses its domestic and international impact.
