Recently, there is interesting research called "law and literature" in China which represents a new stage in law research. In China "law and literature" is divided into two branches, law as literature and law in literature. Law as literature studies law text's language, narration and rhetoric. Law in literature is about law problems in our ancient and modern literature, at the same time it reflects law function. We can know law through literature and obtain professional knowledge. Our ancient court verdict is the current judgment, and ancient verdict in the Ming and Qing Dynasty developed maturely. It can be recognized as a law text and own important value.The thesis consists of an introduction and four chapters, the first chapter introduces forming and developments of ancient court verdicts, including four stages, in order to know the court verdicts systemically. The chapter two focuses on language characteristic, structure and logical research. The chapter three is about law origin and some reasons. The next chapter is concerned with ideological content of ancient verdicts in the Ming and Qing Dynasty.In the concluding remarks, the author introduces language, rhetoric and structure of current judgments. The author tries to give some opinion in the current written judgment We should use some rhetorical types in order to improve conviction of our judgments. And we may import legal precedent system and hope to enhance the transparency of judicial process and public confidence. The fair justice will come true.
