Through the comparative researching on various theories on the criterion of compensatory liability on traffic accident and the legislative evolvement of this criterion in Continental law system and Anglo---American law system ,analyzing the advantages and disadvantages of the criterion of liability for fault and the criterion of strict liability, the thesis considers that , as a attached liability criterion derived from the criterion of liability for fault , the criterion of fault reasoning has the advantages of both the criterion of liability for fault and the criterion of strict liability, brings the function of strict liability to compensate damages into play effectively, due to strengthen the injurer's some strict liability . The thesis also considers that the criterion of fault reasoning has overcome some disadvantages of the criterion of liability for fault and the criterion of strict liability Simultaneously.
