Finance Lease Legislation To Improve Research

Financial Leasing, as the most important financial instrument next to the bank loan, plays a big role in the current economic activities in the developed countries. But in our country, financial Leasing industry is less developed due to the immature and unsound legislation regarding to the financial leasing. Referring to international and domestic legislation frameworks and some research results for financial leasing, this paper aims to provide some constructive solutions to solve problems existing in the legal system of financial leasing in China to perfect our financial leasing legislation and to help a sound development of the financial leasing industries in China. This paper includes three chapters, which are:Chapter one is briefing on the financial leasing legislation, which starts from description of the historic development of the financial leasing industry and its function and exposes its surviving power in the modern economy and society, from which the need of financial leasing legislation are derived. Moreover, by using a way of comparative study, this chapter also makes analysis on the legal position of financial leasing in some typical legislation bodies and different legal systems and legislation models around the world,.Chapter two studies on the existence and problems of financial leasing industry in our country. This chapter is a key part which links the former chapter and the following chapters together and finds the clues for the whole study.
