Study Of Drug-related Crimes

Since Reform and Openness, with the rapid development of economy drug, which vanished dozens of years ago as a sort of social filthy phenomenon, reappears. Drug has brought more and more harm, which has corrupted social organism, ruined social ethos, endangered social stability and hampered economical development. Drug crime has become a global difficult problem in the world. All of the countries fight against drug showing the utmost fortitude, however drug crime has increased more and more promptly. From the angle of view of judicial practice of drug crime the author reviews the provisions of drug crime in Criminal Law, and at the same time explores the recent situations and problems of the trial of drug crimes cases. The author also expounds the concept and classification of drug and drug crime, compares Sino-foreign criminal legislation of drug crime, explains difficult problems in the trial of drug crime cases seriatim, and puts forward revision suggestion of some provisions of drug crime of the Seventh Section of the Sixth Chapter of the current Criminal Law.This paper consists of four parts. The first part is a brief introduction of drug crime. At first, the author summarizes the concept, quality and classification of drug, then we can understand what drug is, how many kinds of drug there is, and which kind of harm drug has. Secondly, the author analyzes the disadvantage of the concept of drug crime, put forward a new concept, and makes scientific classification for better grasp in research and practice. The second part is comparison of Sino-foreign criminal legislation of drug crime. The author narrates the history of the legislation of drug crime in our country, introduces crimes and characteristics of drug crime in our country, explains the characteristics of foreign criminal legislation of drug crime, and analyzes the rationality and shortcomings of criminal legislation of drug crime in our country.
