On The Balance Of Privacy And Limitations Of Public Figures

Through analyzing the public figures and the right of privacy, this thesis illuminates the differentiations between the public figures and the ordinary people lie in the protection and restriction of the right of privacy, not in the possession of the right of privacy; meanwhile, through piercing into social effects of the right of privacy and the freedom of expression, puts forward the legal attitudes of treating the right of privacy, namely,"strategic balance perspectives".This thesis composes of five parts as follows:Part one mainly expatiates the juristical definitions, the social foundations from which the public figures have originated naissance of the public figures and emphasizes on dissertating the definition, scope, styles and social influence.Part two mainly dissertates the uniqueness and the connotation of the right of privacy and anal sizes the characteristics of their rights of privacy, that is the differentiation from the ordinary peoples'rights of privacy and the their own rights of reputation and forms the prerequisite to the single regulations on the right of privacy that public figures possess.Part three and Part four are the most significant among this thesis. They respectively expatiate the theory bases on the protection and the restriction about the right of privacy and emphasize on the analysizing the relationships between the personality freedom and privacy, and restrictions which freedom of expression and public interests throw upon the right of privacy.Part five is the punch line of this thesis. From the above dissertations, the author draws the conclusions that we should be preoccupied with the beneficial balance between the protection and the restriction of public figures'right of privacy. Through concluding the contemporary beneficial balance theories and justice practice experience, distilling the ancient Chinese justices, the author put forward the perspective that we should pay great attention to the strategic balance on the social effects.
