The combination of Internet technology and crimes against intellectual properties results in wider range, higher efficiency of the severe infringement to the intellectual properties. Several problems had not been foreseen while the criminal law was made because of the new characteristic of the Cybercrime against intellectual properties brought by the Internet. So, how to explain the laws to cognize such problems is a subject worth to be studied. This paper includes four parts.Part I introduces the fundamental knowledge of the Internet, Cybercrime and Cybercrimes against intellectual properties and provide the foundation of the cognizance of the Cybercrime against intellectual properties. Part II analyzes several problems which occur in the cognizance of Cybercrime against intellectual properties and focus on the rational cognizance which conforms with the principle of conviction according to law. Part III studies the problems on criminal procedure put forward by the Cybercrime against intellectual properties, and which involve the jurisdiction and evidence.
