China's Maritime Limitation Of Liability Procedures Discussed

Limitation of liability for maritime claims is important in special procedure law of maritime claims. So a perfect procedure of limitation of liability for maritime claims is a guarantee for the protection of the benefits of the responsible party and the whole seagoing system.In this article, the writer began by introducing the international and other countries' related laws to compare the procedure of limitation of liability for maritime claims of China with them to conclude the merits and defects of the nature of the procedure.Then, the Chapter II introduced some of the very features of the procedure in China, while the Chapter III provided the procedure for the person to constitute the limitation fund. The Chapter IV gave its focus on the procedure for registration of claims and the procedure for distribution of the fund. After all these analyses, came Chapter V discussing the problems in existing procedure in China, and has tried the writer also raised own opinions and makes some suggestion.Then, in the last but not least important article, through the study of the nature of the procedure, as well as the other countries' related law, the writer draw the conclusion that to found a complete procedure of limitation of liability for maritime claims in Chinese law is necessary. The writer put forward some legislative suggestions and hopes to work out a better way for the judgment of the case of the limitation of liability for maritime claims.
