Study On The Procedure Of Limitation Of Liability For Maritime Claims

The procedure of limitation of liability for maritime claims is a legal procedure to protecting the legal rights of the person liable. Proving the procedure of limitation of liability for maritime claims is a better way to protect the benefits of the person liable.In chapter IX, "Marine Procedure law" has provided the procedure for the person to constitute the limitation fund . In chapter X, "Marine Procedure law" has provided the procedure for registration of claims and the procedure for distribution of the fund. It will promote the development of the maritime adjudication in China. From the analysis to the procedure of limitation of liability for maritime claims, the writer raised the own opinion and suggestion. Meanwhile, from the analysis to the limitation of liability for maritime claims and limitation fund, the writer draw the conclusion that the necessity to found the procedure of limitation of liability for maritime claims. Therefore, this article does some instruction and analysis to the related national law depends on the civil law and the civil procedure law. Not only does state the concept of it, but also work out a good way that what the principle and procedure to settle it is.According to the national and other countries' related law which is liability limitation procedure of maritime claims, and with the analysis and study depend on practice, the writer put forward some judicial suggestion about it.
