Study Of Maritime Liens

The real right system relating to ship is one of the most essential parts of maritime law, while the maritime lien is the most disputable area in ship real right system. In china, there are few work to study this subject deeply and systematically. The author hopes that the situation will be changed due to this research work and china's maritime legislation could benefit from it.In this dissertation there are several parts for researching the maritime lien as following: firstly the author superficially introduces the original of maritime lien, such simple for the reason that about the original there are more introduce in most of the maritime law teaching materials. Secondly, for the nature of maritime lien which is the focus on the studying by many researchers have made many theories but no agreement in the theory wide so far. The author understand clearly that have little intellect in this area so do not want to research deeply at first, but according to the integrity of the full dissertation ,the author decide to pay some ink for this subject by the way of quoting normal theories. Thirdly, the author mostly hopes to emphasize the object of maritime lien which is the most disputable subject in theory wide. However it is most important to clarify for this reason that there are many different countries, there are so many different provisions. Fourthly, focus on the maritime lien items which are same with the objects of maritime lien, the author will pay more ink. author has researched there are fewer and simpler theories in this area and have not be systematized so far. the author have more interesting in this shortcoming and pay more attention in the following discussion 。The basic notion in this dissertation is to research the prescripts of maritime lien in both maritime law of every countries and international conventions by the angle of theory and practice and to introspect the concerned provisions in Chinese maritime law, in order to find problems and to...
