Circumvention Of Anti-dumping Measures And Anti-circumvention

Nowadays, alongside the steady improvement and frequent application of anti-dumping law, some exporters adopt every possible means to evade anti-dumping duties, which enables them to capture the import countries'market. Considering that it has greatly influenced the international investment and free markets, measures against circumvention have been taken to remedy the effect of anti-dumping law and have become its most important supplement. The anti-circumvention measures in EU and U.S are the most perfect.This article has three parts besides preface and conclusion.In the first part, the author analyzes the definitions, forms of circumvention and anti-circumvention, the nature and legality of anti-circumvention. It helps us to have a systematic and deep understanding of anti-circumvention. In base of the analysis of first part, the second part explicates regulations of anti-circumvention in EU. The author analyzes regulations of EU from two aspects, which are substantive and procedural. It is a good chance for us to learn regulations about anti-circumvention in EU and use it in our formulation of anti-circumvention. In the third part, the author indicates some advices when we confront the anti-circumvention problems in EU in perspective of practice. Then, the author puts forward the legislation design of our country's anti-circumvention law, drawing on the European experiences in enacting anti-circumvention law.
