On The Execution Of Civil Remedy System Perfect

The civil redress execution system is an indispensable part of the civil execution system, which aims at providing effective help to the victims when the execution action infringes their rights and interests. It ensures the fairness and efficiency in the course of execution. At present with the further reform of the civil coercive execution system in China, to study the civil redress execution system will remarkably add the realistic and theoretic value to the improvement of Chinese current execution system.This thesis, firstly, presents the definition, characteristic, type and function of the civil redress execution. Secondly, the author introduces the execution system in foreign countries and Taiwan, China, which provides some reference and experience for our country. Thirdly, the thesis focuses on the problems and its causes by analyzing the current situation of our country. Finally, the author states his own suggestions of how to improve our civil redress execution. First, by learning lessons and experience from foreign countries, especially Taiwan of China, we should divide our future civil execution system into two parts: the redress execution on process and on entity, and set up corresponding examination department and process. Second, we should build up the redress execution on process which contains the execution dissidence and reconsideration. Furthermore, we should improve the execution on entity by building up dissidence law which involves debtor dissidence law and the third party dissidence law.
