As an important right of human and artificial persons, along with the development of social civilization, technology and media tools, privacy is more expected than any period of history. People need more peace of mind, more room for self-activities. In china, privacy hasn't been established, and more and more cases of privacy torts are happening, with the development of web technology and biological technology. Privacy will face more challenges in the new world.Chapter IThe manner of covering some parts of their bodies of primitive human is the origin of privacy. Till the success of capitalism revolution, an equal society in form was established and laws protected privacy equally the first time in history. According to their models, all nations'privacy systems can be divided into three kinds. They are: privacy direct protection, privacy indirect protection, and privacy general protection. The people's civilization, and customer and the nation's political system have important bearings on the level of nations privacy protection. In China, the general character of privacy is that legal provisions are scattered and the methods of protection is indirect and weak. The Civil Law hasn't state directly the privacy protection and it only states personal integrity protection generally. The privacy can't be protected directly and has to be attached to the right of reputation protection, which failed in protecting privacy in many cases. Till 2001,the judicial interpret confirmed privacy as a personality right on its own. Although there are some improvements in judicial actions, in the real society, Chinese people's privacy conception needs much more development. The situation of privacy protection of China has much to do with China's politics and civilization. In China, the concept of right still hasn't waked wholly.
