On The Liberalization Of International Legal Services And Legal Services In The Context Of The Liberalization Of China's Coping

As one of the important means of services trade, the international legal service has been acknowledged into the world trade organization system. Though the trade in international legal services makes up only a small proportion of the whole services trade, considering legal service itself being so close to a country's political and legal issues to the effect of an indispensable part of the superstructure, the liberalization of which has certain particularities and will significantly affect one country's trade and legal culture. Therefore, it is an urgent need for WTO members, including China, to coordinate the relationship between the international legal service and the domestic legal service open-up and to promote healthy development of the domestic legal service. The thesis is composed of three parts:The first part tries to give a brief introduction to the legal service and the legal service trade as a whole, starting with the fountain of the legal service, then the concept of the legal service, the scope, the stipulations in GATS on the legal service.The second part demonstrates in a logical way the evolutionary process of the liberalization of the international legal service, then indicates the forming factors as the market entry, the national treatment and the domestic regulation. Following the analysis of the important role GATS plays on the liberalization of the international legal service, the thesis then analyzes the prevailing tendency of the liberalization of the international legal service and its effect on the international legal service field as well as China's legal service industry. At the end of this part, the thesis points out the conflicts between the liberalization of the international legal service and China's legal service industry.In accordance with the trend of the liberalization of the international legal service and its effects on the international legal service industry and China's legal service industry, the thesis proposes several suggestions about our attorney system reform, and some ideas as well as requirements to Government, law firms and attorneys...
