On The Defects And Reconstruction Of Rural Land Expropriation Procedure

Land expropriation issues have become one of the most serious social problems nowadays. Based on the theories of due process and compulsory purchase, the author has analysed deficiency, harmness and causations of the on-going procedures of land expropriation, researched the mature regurations of some foreign countries'procedures, and has made a conclusion that we should reconstructure our land expropriation procedures, which is the key to deal with the issues during the land taking.For the new procedures of land expropriation, due principles and definite steps should be built up; the purpose of public use shoulde be properly recognized; and also processes should be set up for owners of the land to get relative information, take part in the matter and protect their interests by negotiating with the governments and get relief in court proceedings.
