Restorative Justice In Our Country, The Reality Of Research

A drive for restorative justice has risen in the international society in recent years, which is an alternative dispute settling mechanism developing on the basis of reviewing the unsuccessful factors of the present criminal justice mode. Restorative justice is the system that enables the victim to negotiate with the criminal to settle the dispute under the help of a mediator after a crime happens. The most difference between restorative justice and the traditional one is to restore, that is, restorative justice pays great attention to the restitution of victims and the restoration of the damaged social relationship. Restorative justice offers victims the opportunities to get the compensation,strengthen the feeling of security and settle the conflict ,at the same time, it can make offenders know about the causes and the effects so deeply that they could take the responsibilities, also, restorative justice makes communities understand the decisive causes of crime, then they now it's time to improve welfare and make urgent measures to do something for the return of offenders.As a new juridical model, restorative justice also inevitably exists corresponding shortcoming, but, because of its view and many merits, it has the extremely positive significance to solve the malpractice which our country existing criminal judicature pattern. We have begun to exercise restorative justice in our justice practice field, and try many schemes, which made solid basement for building up this system.This article tries to discuss that our country building up Restorative justice system is necessary and possible, by introducing the Restorative justice and our country's justice present situation. On the basis of researching the Restorative justice practice models, wants to design the concrete system which is suit for our country, the Restorative justice system must runs under our current criminal justice system, and can plays function during each lawsuit stage, and initiative Restorative justice's ideas even outside this system, to promote the Restorative justice system develop farther.
