The Exemption System And On The Analysis Of Anti-trust Value

In the countries with market system, the antimonopoly law, as the core of the economic law, is the main ways to regulate the monopolistic behavior to restrict the competition by the government. With the development of the economic practice and the theoretical study, people have sufficiently realized that the monopoly also has the positive aspects. The exemption system of antimonopoly law refers to the system that some of the restricted competition behavior in accord on the immunity qualification, which violated the antimonopoly law wouldn't be punished, and some of legal monopolistic behavior in special industries wouldn't be applied to the forbidden rules of antimonopoly law.This text analyzes the theory basis of the exemption system of antimonopoly law from three aspects—the economics, the laws and national policies, and demonstrates the nationality and academic significance of the exemption system of antimonopoly law. On this basis, this text researches the value of the antimonopoly law and it's the exemption system, and analyses the value of overall effectiveness, real fairness and competition order of antimonopoly law. In the end, this text introduces and envisages the construction of the exemption system of antimonopoly law our country.
