Research Campus Accident Legal Issues

This thesis ties to do the reseanch from an all new perspective,which is concerning the pedagogy, theory of school managemcnt and science of law. The thesis has analysed different opinons about the handling of campus in jury and has propoposed its own stand point. By using the methodology of sociology. The thesis can be devided into 4 parts:Ⅰ:Introduction. of Campus Injury: This is the basic part of the whole body,The thesis first defines Campus Ingury. then. indicates its significance of law and reality, which is the purpose and intention of this thesis. The thesis also concludes the legistation and practice of campus injury at present , which helps to analyse the problems presented in the next chapters.Ⅱ:Analysis of law problems about Campus Injury. This part is the theoretical focus. It firstly introduces the theory between school and students and gives its own evalvation. Secondly it introduces the legislative examples of the responsibility of school. Then it analyses the arguments raised by different theorists and compares the sino-American differences of Responsibility,and analyses the difference.Ⅲ:The difficulty encountered by the Administnative Practice of our country.This is the difficult part of the thesis. It explains the reasonable period of the school responsible for the campus injury,the standard of the school fault,the adoption of the behaviour of the faculty,the handling of the bady injury of the students in physical activity,the responsibity sharirg with the victirms and the damage of the third person.Ⅳ:Constructing the handling system of campus injury of our country.The thesis analyses from the aspect of legislation enforcement and techniques. and suggests the Scientific Handling Systerm of Campus Injury in our country. It suggests the Responsibility Insurance of our counntry in order to betler protect the students lawful rights and the normal education order of the school.
