The status quo of the gun crime leaves us no reason for an optimisticestimate about its future development. The gun crime not only violates thepersonal rights and the property rights of the victim, but also poses greatthreat to public security. Since the 1980s, gun crimes have being kept onrising continuously, and serious cases of gun crimes such as armedrobberies and gun murders occur frequently, posing great threat to thesocial order. The reason why gun crimes tend to have serious threat to thepublic lies in that guns have more destructive power compared with otherweapons. Those crimes committed by using guns can result in the intensepsychological disturbance and threat to the victims, causing serious harmto the victims' life as well as the public and the private property. Andthose crimes with guns as their object are mainly committed for obtainingguns so as to commit other crimes by using guns, which also posespotential threat to the society.Gun crime is a newborn concept. Since the 1980s, especially the earlyyears of 1990s, as the crimes related with gun usage gradually develops,the departments of public security sum up this technical expression of thegun crime in the process of expropriating guns and combating violenceand gun crimes. From the intrinsic regularity and the manifestation of guncrimes, this dissertation is a preparatory analysis of the concept of guncrime and its features of criminal law study. The author believes that guncrime is theoretically a general term referring to the violation of ThePeople's Republic of China Guns Management Law under the regulationof The People's Republic of China Criminal law and various criminalbehaviors with guns and ammunition as their object or tools in the crime.It is a definition and a classification in theory of those criminal behaviorsrelated with guns and ammunition.Through an analysis of the macroscopic characteristic, thecharacteristics of space and time, the characteristics of the main body andthe behavioral characteristic, the cause of information will be traced from various angles, such as the society, the economy, the social system, thesocial environment. The author believes that, in the strategy of combatinggun crime, it is crucial to establish a system of scientific and systematicinvestigation and protection, including two constituting systems, thepreventive systems and the investigative systems for gun crimes. Thesetwo systems must depend upon each other for support and guarantee.Either of them demands the other for support and supplement. In theprocess of investigation into gun crime, the author proposes that in orderto combat gun crimes punctually, actively, continuously and effectively,such systems as quick reaction, multi-facet cooperation, combination ofsome related cases and investigative guarantee have to be established. Tofurther the argument, the author also proposes some suggestions on theinvestigation about some typical gun crimes such as gun murder,gangdom-related gun crimes, and illegal production and transportation ofguns. In the case of preventing gun crimes, the author classifies thetheory of preventing gun crimes into there distinct levels according to thetime when the gun crime takes place and the consequence of the crimes,namely elementary prevention, intermediate prevention and high-levelprevention. Base upon these three levels of investigation, the author raisesa suggestion of controlling the criminal tools, the criminals, the importantobjects of crime and some special industries, and proposes a system ofcomprehensive investigation upon the societal conflicts, report of thewitnesses and the intelligent information.However, we must bear in mind that prevention and investigation ofgun crime can not be achieved at one strike. On the contrary, it requiresour persevering efforts for a long time. The police departments, on the onehand, must ensure a high efficiency on the investigation of crime, and onethe other hand, consolidate its function on the grass root level, strictlycontrolling guns and ammunition and obstructing the illegal transportationof guns. Surely a thorough dependence on the police departments for theprevention of gun crimes is far from enough. As a systematic project, thebasic approach to the prevention of gun crimes lies in a comprehensive management of the society and a fully activation of the responsibility ofany single department. We must rely on all the following strategies: theestablishment of an effective social security system, a clean socialatmosphere, the propaganda of social justice, the strengthening of moraland legal education so as to improve the people's awareness of law. Onlythrough such measures can we effectively prevent the occurrence of guncrime so as to ensure the prosperity and security of our society.
