In 2002, U.S president George W Bush signed the No Child Left Behind Act. Until today, NCLB still significantly influence the elementary as well as seoondary education of United States. The core goal of NCLBA is to improve academic performance of every child in United States and to achieve educational equity. The four factors, teacher quality, public school performance, teaching approach and communities, are the key component for student academic achievement improvement. Therefore, the Act tries to carry out the initiatives of these four aspects with the support of federal funds and ultimately, achievement the core goal of NCLB Act.To feasibly implement the law, states need to be given flexibility. Flexibility exists universally in almost every provision of the NCLBA including the provision of HQT, academic assessment and standard and the federal funds utility. Some of the flexibilities were formed during the formulation of the Act, especially during the passage of the congress to earn support from the representatives, interest groups and also the Democrats. On the other hand, part of the flexibilities mentioned in this paper was formed during the period of Act implementation due to political compromise with the states as well as the tricky problem the implementation faced.To a great extent, flexibilities enable states to implement the Act according to their own situation and reality, which could bring out the best outcome. Yet, the flexibilities also resulted in variation among states. Flexibilities are given mostly on the tough issue the Act wanted to handle. Yet, while the states lack the willingness of handle this tough issue, flexibilities turn into opportunities for the states to run away from the NCLB requirement, which lead to a opposite implementation outcomes.Yet, no one could deny the necessity of flexibilities in the NCLBA since essentially, the federalism, despite its variation in definition during these 200 years, required the existence of the flexibilities. None of the Act without flexibilities could possible implemented. However, the effect of flexibilities of an Act depends greatly on the willingness of the implementer.
