Study Of Administrative Behavior Scope Of Judicial Review

The scope of judicial review is one of the major contents of judicial review of administrative act regulation, it has direct connection with level of the development of administrative law. Via the basic analysis of the idea of the scope of judicial review , this thesis discusses the value basis and fundamental principle of the modern system of the scope of judicial review; through hackling many countries different areas of judicial review, this paper sums up the essential features of the scope of judicial review. On the basis of the assessment of the essential contents, characteristics and issues over China's current scope of judicial review system, integrating the demand of the doctrine of the rule of administrative law, this article gives a specific discussion of some contents and schemes of China's system reform of scope of judicial review through two aspects, that is, develop the target of judicial review of administrative act in width ,such as abstract administrative act analogy administrative act internal administrative act final administrative act. And enhance the might of judicial review of administrative act in depth, for instance: factual review and legal review noumenal review and procedure review legitimate review and reasonable review.
