This research paper, which is divided 4 chapters, is concerned about the social harmfulness, constitution, justice finds, determination and penalty of drug trafficking.In the first chapter, the author makes a general introduction to the drug trafficking which covers the definition, the sorts, the characteristics of the drug and the social harmfulness of drug offenses and drug trafficking at home and abroad on the relevant legislation, the basic outlines of the crime of drug trafficking. This research paper starts its discussion from the special social harmfulness of drug offenses.The second chapter is concerned about the constitution of drug offenses which includes the object, objective elements, the subject, subjective elements of such a crime .In this chapter, the author specially focus on the object of this crime is related to the controversial objective of "drug trafficking" the understanding. There are some main issues, such as contention of whether there was "illegal profiteering" in the crime subjective element.The third chapter is concerned about judicial conviction of the crime of drug trafficking knotty problems. Author describes the perpetrators of the crime attempted to define the crime of drug trafficking; drug-trafficking crime to commit to the existing problems; there are temptations investigation for drug trafficking; trafficking in counterfeit drugs and adulterated drugs qualitative; drug trafficking and illegal possession of narcotics crime, and ensuring that problems with theft and trafficking of narcotic drugs in the center of crimes and other issues.The fourth chapter covers the determination and penalty of drug offenses. The author focuses on the general provisions of the penalties for drug trafficking and the problems that exist in drug trafficking sentence.
