Folk loan is an old finanial way with a long history and it is still existence in the modern highly-developed finanial society . Nevertheless , we are still not mature in the research of it , and there are till a lot of faults and shortcomings in this feild , and among them the most apparent ones are as follows : 1,there are a lot of partial opinions about folk loan ; 2, Influened by the main traditional viewpoints , we deal with the problems of the folk loan by the way as the high interst . Study current situation for the law relation of folk loan , in my opinion , we should expand the subject system of the folk loan include individual, enterprise and other organizations and new thinking for the contract of folk loan . We should make clear the differences between the folk loan and the high interst .between the folk loan and the illegal loan.
