Study Of Private Law’s Regulation Of Folk Loan

On December6.2011,the Supreme People’s Court issued a notice on the proper trial according to law folk loan disputes to promote economic development and maintaining social stability, the courts at all levels to actively practice the active judicial philosophy, and give full play to the judicial functions properly to resolve disputes of folk loan, and promote economic development maintaining social stability. In this paper, two real cases lead to the folk loan from the civil point of view, legal analysis and then the thinking of the rule of law, folk loan folk loan norms development proposals. The article is divided into five chapters, each chapter is briefly as follows:The first chapter is "folk loan overview" to explore the concept of folk loan, legal nature and type of introduction of China’s folk loan.The second chapter is "folk loan principles to be followed" to folk loan as an act of civil law, should follow the basic civil principles.The third chapter is "foreign folk loan and folk loan China reference" by private in the USA, Japan, South Korea and Bangladesh to learn from these.The forth chapter is "China’s folk loan law and Comments" to explore the norms of folk loan laws and regulations, and its assessment to identify its laws and shortcomings.The fifty chapter is "the rule of law regulating about folk loan thinking" to find the proposals for regulating our folk loan about the third chapter.
