This thesis, taking"Labor Contract Law (Draft)"as the background, raises some views and suggestions about prominent issues on legislation and practice in order to provide some simple perspective on the theory and practice of labor contracts legislation.The main contents are as follows:1. For a detailed distinction between the more confusing labor contracts, labor contracts and the employment contract theory and practice and lay the theoretical foundation to highlight the problem of labor contracts.2: To analysis the reasons for the adverse effects of "Labor Contract Law (Draft)"'s collecting suggestions from the community in the process of improving labor protection standards.3: For widespread practice, the second career terms, from the theoretical perspective, has little been mentioned. The author, according to his own analysis and presentation, conducts the second career provisions of the legislative proposals.
