On The Crime Of Smuggling Ordinary Goods, The Goods

Smuggling common cargo and article is in practice a familiar smuggling crime. According to some statistics, among the smuggling cases made by customs anti-smuggling sections, 90 percent cases belong to smuggling common cargo and article cases. The behavior of smuggling common cargo and article directly influences the national revenue and badly harms the national benefit. From the justice practice of fighting smuggling crime, the provisions about smuggling common cargo and article in our Criminal Law are faulty. There are odds in crucifixion collocating, charges in an indictment are not frondose, and crime setting mode is not so perfect. They are the careless omission in crime form design. Therefore this paper analyses the problems about accusal intercalating of smuggling common cargo and article, crime composing and cognizance, in order to correctly understand this crime and benefit the theory research and justice practice.
