| The right of criminal victims was neglected for a long time. Usually the Criminal Law put big attention to culprits, especially focus on the human rights of them .After our Constitution provides: "we respect and protect human rights " , there was no more improvement about human rights of criminal victims protected by Criminal Law. Compensation to criminal victims is widely accepted by more and more people .The Criminal Law was the Constitution of culprits, was the Constitution of citizens .it also should be the Constitution of criminal victims. So the author want to discuss the compensation to criminal victims from Criminal Law.The paper is composed of four parts.The introduction part : summarized the research results of compensation to criminal victims of our nation.Part one include the definition of criminal victims, and introduce the power of sue of criminal victims in different models. Finally summarized the sue right of criminal victims and tell the real life of criminal victims.Part two introduced the systems of compensation to criminal victims. First wrote the legend of compensation to criminal victims, then compared compensation to with culprit compensation and national compensation. Second introduced some basic theory of compensation to criminal victims. Finally introduced systems of compensation to criminal victims had been set up by American, UK, Japan and so on.The main idea of part three is the human rights protect by Criminal Law. It summarized the protection of human rights by Criminal Law. And testified the protection of human rights by Criminal Law should include criminal victims.Part four told compensation to criminal victims from criminal justice. By refuting the definition of justice, then analyzing the justice of Criminal Law. Finally conclude that compensate to criminal victims is realized all the criminal justice.The conclusion to establishing The Criminal Law should play a big part in construct the system of compensation to criminal victims. |
