International commercial disputes become more and more with the fast development of the international trade. International Commercial Arbitration is the most useful and fruitful method which has been accepted by international society to solve the international commercial disputes.In terms of international convention, every country's court supervises the international commercial arbitration made in their nation; one of the most manifestations is that the court has the authority to revoke the awards which have been made before."Convention on the Recognition and Enforcement of Foreign Arbitral Awards" (hereinafter referred to as "New York Convention") and "UNCITRAL Model Law on International Commercial Arbitration" (hereinafter referred to as "Model Law") are the international basic gist for revoking the awards. However, every country has its own feature in mastering the international basic gist because of the different comprehension on "New York Convention" and "Model Law" and the differences among every country's law. Moreover, there are many problems when make it into practice.China carried out "Arbitration Law", Supreme People Court enacted a series of judicial explain and notice. All these provide our court with law and practice gist for supervising the international commercial arbitration awards. But our country has little theory research and law ordain in revoking awards; another reason is that the local courts have different comprehension and application in laws due to the Chinese incomplete related laws, international commercial arbitration and the complexity of the each country's law.This paper analyses the confronted law issue when it made into practice, and, combined with development trend of the international commercial arbitration, also makes a suggestion that how to complete Chinese international commercial arbitration award's revocation system.
