With the development of economic globalization and enforcement realization for world environment protection, free trade and environment protection become the popular trend in the recent society. Since the foundation of WTO, the effect of environmental measures on market access, especially in relation to developing and the least developing countries has turned out to be the focus issue. On the fourth ministerial conference of WTO, which was held in Doha-the capital of Qatar in 2001, with the mutual effort by members of developing countries,《Doha Ministerial declaration》has entitled the effect of environmental measures on market access, especially in relation to developing and the least developing countries, to be the particular attention subject of the Committee on Trade and Environment. As one of WTO member countries, China also needs to face the trouble issue actively. Therefore, researches on the effect of trade-related environmental measures on market access, is of great help to the implementing of WTO negotiating agenda, and also important to china's foreign trade development theoretically and practically.This dissertation deeply researches the coming of multilateral trade system and the environmental issue in the view of international law, by theoretical and practical methodology analysis concerning influences from trade-related environmental measures on market entering, finally provides some concerned suggestions according to the recent challenges.There are three chapters in the body of this dissertation as below:Chapter 1 gives a general introduction to trade related environmental issues. First discusses the inter connection and influences between free trade and environmental protection both positively and also negatively; then the necessity analysis on WTO trade and environmental subject, not only from the theoretical trade environmental differences between developed and developing countries, but also from practical view on dispute settlement body and environmental disputes, provides solid theoretical foundations for the coming chapters.Chapter 2 concerns on the trade related environmental influences on market access. First introduces the definition, characteristic and related legal issues of trade related environmental measures; then comes the definition and fundamental principles of market entering; next studies the effect of trade-related environmental measures on market access.Chapter 3 deals with the temporary conditions and problem solutions on china's environmental measures and market access. First introduces the legal environmental system; then points out the problems based on the basic condition research, and also suggests related solution measures; and then discusses influences from main trade company countries'trade-related environmental measures on china's market access; finally puts forward some corresponding strategic solutions from domestic and international perspectives.
