China's population will age rapidly in the very near future. How to deal with this situation has becoming one of the most important problems of our country. The long time of policy of family planning has led to a result that there is a large number of"four-two-one"type families in China, which two couples have to raise four elders and one child, therefore the economic burden of raising the elders is especially heavy.To solve the problem, it is necessary to perfect our social security. Also, there is a new assistant tool, named"Reverse Mortgage (RM)", which can increase the income of the elders who has an independent house. To build a wholesome legal system for RM is the main purpose of this paper.This article firstly describes in detail the concept of RM and its status quo in developed countries especially in America, then by the comparison among RM and several relative systems concludes the characterizes and advantages of RM. Then, this article analyzes the sense and risks to operate RM in China.In order to control risks, first important of all is to design a clear, incontrovertible and exercisable contract to protect the legal rights and interests of the parties. Besides that, this article emphasizes on several other settlements, such as choose reasonable institution participants, governments encourage and support, amend or constitute correlative laws and statutes, strengthen financial wardship, etc.
