China's rapid economic development is currently in the decisive stage of building a well-off society in an all-round way.The quality of people's lives has greatly improved.Compared with the past,people's lives have become longer and longer.Serious population ageing.Due to China's special national conditions,the basic national policy of family planning has been implemented since the 1980 s.Although the family planning policy did have some effects at the time and reduced the rapid population growth,it has now exposed its shortcomings.The "421" structure has emerged,that is,both parents need this couple to support,and at the same time they have to raise their own children,which has brought tremendous pressure to many young couples.Although the “Comprehensive Two-Child Policy” was implemented in 2016,the policy still cannot solve the urgent needs of the elderly for the post-fifties,sixties and some seventies.Because China's current economic development is not sufficient and social security measures are not perfect,China's old-age security system is facing unprecedented challenges.So how to effectively deal with the problem of population aging in China? In addition to the development of China's basic social security system,the development of reverse mortgage loans for housing is an auxiliary means to promote the continuous improvement of China's social security system.Reverse mortgages are mainly for those who have a home but have less money.In order to obtain a stable loan to improve their quality of life,they mortgaged their home and applied for a reverse mortgage on the house.The bank will take ownership of the house directly after the applicant's death.The model of reverse mortgage on housing has existed decades ago and has proven to be very effective in practice.At present,there are relatively few cases of prototypes based on reverse mortgages in China.The system has not been well practiced and developed in China.In fact,this system is urgently needed in China.In this social environment,this article first starts with the concept of reverse mortgage loans and understands the theoretical background and development status of reverse mortgage loans.By analyzing the mode of the implementation of the reverse mortgage system in foreign countries,we can draw lessons that can be learned.Second,this article examines the status of implementation of the system in China,and analyzes the obstacles and risks it faces.Finally,it can be concluded that the operation of China's housing mortgage loan system coexists with benefits and risks.We must "take the essence and remove the dross" according to the implementation status in foreign countries,make the system in line with China's national conditions,and then combine domestic data to find out the current problems of reverse mortgages in China and propose solutions.Finally,this article puts forward proposals for the implementation of China's reverse mortgage loans,such as improving the supervision system and regulating the legal process of reverse mortgage loans.The housing reverse mortgage contract is stipulated in the relevant laws as a well-known contract,and its establishment,functions,procedures and related content are strictly regulated through relevant legal provisions.Regulate it in the form of law,thereby institutionalizing,standardizing and legalizing thereverse mortgage of housing in practice.
