As we all know, biens immubles is more important than biens mubles to people. For example, house is the people's basic living materials. So, creditor who want to acquire the ownership of biens immuble should be specially protected by law. Registration of caution just is one of the legal structures.This paper includes three parts, that is introduction, straight matter and conclusion. And, the straight matter of this paper is made up of five chapters.Chapter one presents the general situation of Registration of caution, like concept, history, sphere of application and jurisprudential background .Chapter two ,the requirement of Registration of caution, the transfer and extinction to Registration of caution. The requirement of Registration of caution includes formality requirement and material requirement. The Registration of caution can transfer together with creditor, but cann't transfer by itself.Chapter three, the validity of Registration of caution. Generally speaking, Registration of caution will give the creditor four kinds of validity. This chapter is most important.Chapter four, the nature of creditor by Registration of caution. Is it a kind of real right, obligatory right or a new type of right? It is difficult to work out.Chapter five, is the final chapter, mainly about how to apply this institution of law in China. Real Law of The People's Republic of China regulate Registration of caution, the author put out herself viewpoint.
