Police Chief To Guide Research

With the development of marketing economy and progress of social civilization and people's warm welcome to the thought of running our country by democracy and law, modern administration and the theory of public service require police office to get rid of the traditional of police administration which only depends on compulsory ways. Police office now should actively meet the challenge of building and effective and responsible government. Behind the background of building a harmonious society, as a kind of non-compulsory police administrative action, administrative guidance of police is used by police office to make the related person accept its meanings and put them into practice by means of non-compulsory ways like giving suggestion, advice, guidance, order and encouragement in order to realize the administrative goals of keeping peace in the circle of its legal rights. Therefore, administrative guidance of police plays an important role in realizing the administrative aims or "increasing the factors of harmony to the most and reducing those of non-harmony to the least". It also has been developing very well and widely practiced. However, because it is not a term in law as well as it has not got a clear position in study, many problems exist in the theory and practice of administrative guidance of police.By means of historical research, analysis of examples, contrast, description of reference and study of problem-solving, this paper makes a study of our country's theory and practice of administrative guidance of police from four aspects. First of all, by analyzing the quality of administrative guidance of police, it is proved that administrative guidance of police is a non-compulsory police administrative action. In this part, it also discusses the components, basic types of administrative guidance of police, its relation to administrative guidance, as well as the differences between administrative guidance of police and its related terms. It is concluded that, as non-compulsory police administrative action, administrative guidance of police belongs to a new kind of police administrative action which includes punishment, police license and so on. Administrative guidance of police is also the main point on which police office begins its creative ways of administrative management. Secondly, this paper focuses on the relationship between the basis of balancing theory and legal management. The main efforts are put on the tradition of law culture and basis of administration through which administrative guidance is widely used in our country. This part also studies the function and value of administrative guidance of police from the angle of social management. Thirdly, under the investigation of law system and practice about administrative guidance of police in Taiwan, our mainland, Japan, South Korea, this paper analyzes the problems existing in administrative guidance of police. The result shows that there are still some problems due to the theoretical immaturity of administrative guidance of police and its imperfection in law. At last, it is concluded that, in order to put administrative guidance of police into the field of running our country by law, the basic administrative principles such as legal reservations, law priority, equal treatment, proportion, reliance protection should be seriously implemented in administrative guidance of police; the procedures of administrative guidance of police should be perfected to promote the development of police administration system.
