What is the severest crisis the human being encountered last century? It is environment crisis. And this is a commonsense of no consest.With the increase of world's population and development of economy, there are international environment problems. The environment problems of nowaday are the heavy cost payed by human being for the great development of humanity social of last century. The natures of harmness, complexity and hard to resume, embodied by the environment problems in practise, are more serious than the harm mentioned above. The environment problems become important problems, which are closly linked to the survive and development of human and all human being must envisage and introspect. In order to resolve the environment problems, we must use all the right knowledges to the subjective and external of the world, including the knowledges the human have controled and that are foreseeable in the future. Jurisprudence has its responsibility for the resolvement of such problems, therefore, the missions of jurisprudence are enlarged.Environment law becomes a new law department in this context. The theory of environment legal liability of great value for studying is one of the basic theories of environment law. It is need for the study of environment legal liability to be prudence in theory and coorespond to the reality, which are the intent of this paper.This paper holds that the solution for the environment problems are prevention in advance which not only means persuade in ethic, but means that the legal liability should be the surppoter. That is to say, the actions offending the environment prevention measures should bear legal liability, anyone who caused the damages, including damages to the property and person as well as the damages to the environment itself,for example losing aesthetics value, caused by the environment problems should bear legal liability. These aspects, especially the latter one,are the categories the environment legal liabilty should research.
