In the course of Chinese urban constructions, the law on ownership of apartment house is performing more and more important role in adjusting the law relationships among owners of apartment houses, developers and property managers. It includes the ownership for special part, right of taking disciplinary action on common part and the right of membership. Our laws on ownership of apartment house are hardly seen after the establishment of our country until March 16th 2007 our Property Law was announced. But the contents do not supply the answers on some questions that often seen in reality, such as the border between the special part, the sphere of the common part, the rules on owners'committee, and some questions about parking zone. And how to restrain owners to misuse their apartment house is not mentioned. In this article, the author first analyzes the history of ownership of apartment house and its characteristics, contents. Then analyzes the legal systems on ownership of apartment house in France, Germany, Japan and America on the special aspects on the weakness of our law, Finally, the author explains the contents on ownerships of apartment house in our new Property Law, and puts forward some legislative proposals .
