The fictitious property in net games refers to a type of digitalized property, which is created by net game players according to specific rules and software of the games. The property shows to people apparently a series of equipments, roles and coins in the games, but in the physical performance it is a string of electromagnetic records that relies on specific network server and virtual space.The property has some special attributes, such as fictitiousness, invisibility, objectivity, availability and short-term existence. On the other hand, it also has the common attribute of legal property: the value, the use value and the exchange value. Therefore, the fictitious property should be ruled and protected by the law.From the viewpoint of causes the virtual property disputes mainly involve fictitious property theft, fraudulent transactions, and those that operators stopped operations and closed game accounts.The legislation on the fictitious property in the net games is not necessary. The fictitious property has not left the human society and the behavior of individuals. Online games industry has developed rapidly and the legislation will disrupt the existing legal system. And the advances in network technology can eliminate a large number of fictitious property contradictions.Measures should be taken within the existing legal framework. The fictitious property must be put into the real property. Violations of fictitious property will be classified into property crimes. The illegal intrusions into computer systems of ordinary citizens should be considered as crimes. At the same time, network real name system must be implemented gradually and the obligations of online game operators need to be ruled clearly.
