Virtual property in online games has already been an important part of economic field and daily life.Virtual property has been more and more clearly perceived by users in the information age with the progress and development of the Internet Age.Virtual property has been listed as the object of property protected by civil law while the process of drafting the Civil Law.However,the regulations of ‘General Provisions of the Civil Law of the People's Republic of China' on virtual property are too broad to protect Virtual property.The judgment on virtual property even become worse after the promulgation of the general principles of civil law.The best method to deal with such problem is drafting relevant laws.The first chapter of this paper starts from the objective environment of the virtual property in online games,after introducing the general definition of the narrow sense virtual property,it will list the main types of the virtual property of online games in the current network world of our country,and explain the characteristics of the virtual property of online games in the virtual economy.The second chapter focuses on the introduction of the magic circle theory of virtual property,and analyzes the perspective of virtual property of online games under the framework of magic circle,and analyzes the relevant theories of the right attribute of virtual property in traditional academic research.The third chapter analyzes the related problems in the judicial practice of our country,analyzes the related problems from the aspects of the unclear location of the virtual property of online games,the difficulty of publicity,the obstacles of transaction and the obstacles of value recognition.Finally,analyzes the impact of the related problems and the causes of the formation.The fourth chapter analyzes the legislation related to the virtual property of online games,focusing on the Charter theory and related judicial cases of the United States online games,the legal basis for the effective protection of virtual property ofonline games in South Korea and the evaluation industry system in South Korea,and the electromagnetic record theory in Taiwan.The fifth chapter will try to construction civil law protection system through the theory of magic circle.This part could be devided into four parts.Including Clear positioning of property law,establishing publicity system,supervision evaluation system and establishing virtual network service contract system.
