Trade Secrets System Of Legal Protection

Internationally speaking, the special legislation protection and international protection for trade secret are two trends. Domestically speaking, the distempered system of the legal protection of trade secret, the dispersive legislative style and the low maneuverability bring juridical practice a series of problems. Trade secret is a dynamic concept per se. As the integration of the international economical trading, the extension of trade secret is broadening constantly. Quite a few questions deserve further discussion, and innovation is badly needed for the original legal system.With the basic legal doctrines, borrowing the research findings at home and abroad, combining the current legislation protection for trade secret and juridical practice in China, I made delimitation of the trade secret, and make clear the components, legal nature, subject and object of right and content of trade secret. The theoritical foundation and the mode of the legislation protection for trade secret, civil legal protection of trade secret, the impingement and remedies of the trade secret right is discussed in the text. In order to intergrate with TRIPS, concluding that there still shortages of the Chinese current legal protection for trade secret, I put forward some suggestions that it is necessary to establish a special legislation to protect trade secret in China.
