Research On Privacy Protection Under The Constitution Sight

In China, privacy has been a vacancy on the concept of law. Scholars always discussed legal protection of privacy issues on civil law. But in fact, in the process of China's system transformation,government power for people or regulations are everywhere. If the freedom of personal privacy can not liberate under the control of government, there is no true personal privacy in fact. Because the civil law's protection of privacy limited to the equality of the main's right violation, it can do nothing facing the state power violate people's privacy, so only rely on the civil law's protection of privacy is absolutely not enough. It is essential to put the protection of privacy into the scope of constitution. This dissertation through introducing foreign mature theory and practice of constitutional protection of privacy, from the universal human rights protection to analysis the basic problem of the constitutional protection of privacy, it aims to make proposal on the constitutional protection of privacy combined with situation in China.
