Analysis "International Covenant On Economic, Social And Cultural Rights" In China's Implementation

After World Warâ…¡, the human rights became an international matter of concern. The United Nations passed a series of documents, manifestos that related to human rights. Other International organizations, regional organization have also drawn up many international documents, which concerned human rights. The United Nations has also established many global human rights organizations to fulfill the responsibility of assuring the human rights. The present era is a material civilization, the system is civilized, the spiritual civilization develops highly, the human rights receive the unprecedented respect. The reform and opening policies, which started from 1978,not only made our country economic society obtain huge development, but also accelerated our country's internationalization advancement enormously. Our country was allowed to join the World Trade Organization (WTO) in November,2001, which symbolized our country had integrated the international economy big family. In October,1997 and in October,1998, Our country Government signed "Economical, Social And Cultural Right International convention" and "Rights of citizens And Political rights International convention" separately, which symbolized that our country showed a more open posture in the international scene. If joining the World Trade Organization is a big event in our country economic life, we can undoubtedly say that signing and joining these two international human rights joint pledge are an important milestone during political development in our country.Based on the above understandings and through studying our country fulfillment situation to "Economical, Social And Cultural Right International convention" and present situation of our country's economic, social and the cultural rights, we can definitely say that our country has made very great accomplishments. However, disadvantages are also obvious. For example, some important rights cannot be seen from our constitution and other laws. These rights, including striking right, moving freedom and living freedom, are just the core right protected by the convention. Based on the inspection to related theories, the paper further inspect some important questions,such as the history, structure and important economic, social and cultural rights in the convent, as well as the convent's implementing mechanism and the relevant right restriction. The paper's significance lies in not only having clearly showed the relevant important questions of the convent but also having showed that all the rights are equal and important to person's dignity. So both government and citizen should attach equal importance to all the rights in behavior and consciousness.When implementing duty of international human rights convention, we cannot simply follow the former procedure, but we should take attitude of keeping pace with the times in order to promote the development of our cause of human rights by the chance of implementing the duty. Only to treat the duties of two international human rights covenants scientifically and seriously and approve the International covenant on civil and political rights in proper time, we can truly become a large country in human rights protection and then play our due role in human rights protection at international stage.
