On The Construction Of Expert System Of Legal Opinions

China today, judicial corruption still exists, the court should have the authority and the lack of convincing. This has not only hindered the China-depth development of the rule of law, but also the resulting judicial injustice even has a direct impact on the stability of the social order. In the process of building the rule of law in China and the reality background of the country's judical system facing major reform, how the "friend of the court" system introduced to China undoubtedly has a strong practical significance . And the establishment of a system, not only to China's in-depth study and analysis of the specific status quo, but also from the world's current and effective approach.This paper focuses on legal experts from the theoretical foundation and practical significance, and the United States' "friend of the court" Comparative Analysis of the system in improving the submission of the recommendations of the legal experts. Specifically, the article can be divided into four main parts: the first part briefly introduces Chinese experts' legal submission issued by the status; by comparative analysis of experts' legal submission with "friend of the court",the second part identifies the same points and different points,and the existing problems and deficiencies of experts' legal submission; and the third part is the core and focus of this paper, which, in view of the existing legal submissions from the United States and lack of "amicus curiae" system on the basis of the author expounded on China's system should grasp experts from the principles and the specific concept of expert legal opinion on the application of the main system, scope of application, start-up mode, as well as monitoring and protection mechanisms author's own perspective;As a closing, Part IV summarizes the writer's opinions.
